Madrid, 30, was originally charged with felony child abuse after police found Rodgers’ seriously injured Wednesday at the Aurora apartment Madrid shared with Rodgers’ mother.
When Rodgers’ died Thursday evening, police said they planned to upgrade the charges against Madrid, who has been in jail since his arrest last week.
In addition to the murder charge, Madrid faces two counts of child abuse resulting in death.
Police said they responded to the apartment in the 100 block of Dayton Street on Wednesday after Rodgers’ mother, who left the toddler in Madrid’s care while she was at work, returned home to find him seriously injured.
The Arapahoe County coroner’s office has not released Rodgers’ cause of death, but said they completed his autopsy Monday.
Madrid, who is being held without bond at the Arapahoe County Jail, is due in court Jan. 31 for a status conference.
